Acknowledgments

What is a notary acknowledgement? Notary acknowledgements verify the authenticity of sworn statements that are submitted as evidence in a court case. 

An acknowledgment requires the following steps:

1. The signer must physically appear before you.

2. The signer must positively follow according to the state’s rules.

3. The signer may either sign the document before or present.

4. The signer must declare (acknowledge) signing the document for its intended purpose.

The signer must be able to directly communicate that he or she willingly signed the document.

Wills

Once you have signed the document, the Notary will affix her or his stamp (or “seal”) to the document. The document is now notarized. Having a document notarized is the same as swearing under oath in a court of law—you are saying that the facts contained in the document are true.

Loan Closings

The closing agent's role is to make sure all parties involved receive required documents during a mortgage loan closing. They provide escrow instructions to third parties like real estate agents, to receive funds such as fees and commissions.

Power of Attorney

A power of attorney is a legally binding document that grants a specified person power over his or her assets, legal-decision making, real estate transactions, and medical decisions in the event the individual is incapacitated or otherwise unavailable.

  • Making financial decisions

  • Making health or medical decisions (including stopping medical treatments or services

  • Protecting or claiming personal or estate assets

  • Operating business interests/transactions

Notaries play an important role when executing a power of attorney.

Jurats

The purpose of a Jurat — also known in some states as a “verification upon oath or affirmation” — is for a signer to swear to or affirm the truthfulness of the contents of a document to a Notary or notarial officer.

A jurat requires the following steps:

1. The signer must appear in person and sign the document in the notary's presence.

2. In some states, you are required to positively identify the signer.

3. Administer a spoken oath or an affirmation, and the signer must respond out loud. Silent answers such as a nod of the head are not acceptable.
